John Hoyt (1638–1696), son of John Hoyt and Frances Unknown

Mary Barnes (say 1638–after 1704), daughter of William Barnes and Rachel Unknown

John Hoyt was born about 1638. [1] He and another man were killed by Indians in Andover, on the road ot Haverhill, on 13 August 1696. [2] He married Mary Barnes on 23 June 1659 in Salisbury. [3]

Mary Barnes was born say 1638. She was alive in 1704.

Mary Barnes father refers to Mary as Mary Hoyt and to John as his son in law in his will of 1696. [4]

John Hoyt, Jr. took the oath of fidelity at the 9: 2: 1667 court. He was chosen by the town of Salisbury to keep the ordinary and at that same court he was licensed to sell wine and strong water for the following year. He was also dismissed from all trainings until such time as his infirmity had healed. His liquor license was renewed in 1668 and 1669. [5]

On 6 March 1694/5 John Hoyt, former constable of Amesbury and then in jail in Salem, petitioned the general court of Massachusetts Bay. He said that he was in jail for non-satisfaction of the arrears of the rates committed to him to collect while he was constable. He complained that his house had been plundered by Indians and visted with much sickness. He said that many of the people from whom arrears were due were dead or had left town. He asked to be released and given two or three years grace for payment. On 8 March the court granted him release and two years grace. [2] It is not known if he managed to make payment; he was killed shortly after.

On 7 August 1697 Mary Hoyt, relict of John Hoyt of Amesbury, relinquished her right to administor John's estate and requested that their third son Joseph Hoyt be appointed instead. Joseph Hoyt and Jarvis King posted a bond on 9 August 1697. [6] Inventory was taken on 5 November 1697 and amounted to only £7.14.09. There was no real estate included but his widow seems to have had a homestead as in 1704 she deeded it to her youngest son Robert. [2]

John deposed that he was about 40 on 23 November 1680 and about 46 on 29 September 1684. Given the birthdates of his twin brothers, the latter date deposition is probably more accurate.
